These Terms & Conditions (“Terms”) govern your use of the MasteryByte platform (“MasteryByte”, “we”, “our”, or “us”). By accessing or using our services, you agree to these Terms.
1. Use of the Service
MasteryByte provides an online platform for creating, delivering, and analysing assessments. The service is intended for use by schools, educators, and authorised users.
You agree to use the platform only for lawful purposes and in accordance with these Terms.
2. Accounts
To use MasteryByte, you must create an account. You are responsible for:
- Maintaining the confidentiality of your login credentials
- Ensuring that all information provided is accurate
- All activities that occur under your account
We reserve the right to suspend or terminate accounts that violate these Terms.
3. Organisation Responsibility
If you are using MasteryByte on behalf of a school or organisation, you confirm that:
- You have authority to act on behalf of that organisation
- Your organisation is responsible for managing users and student data
- Your organisation acts as the data controller for student information
4. Acceptable Use
You agree not to:
- Use the platform for unlawful or harmful activities
- Attempt to gain unauthorised access to the system
- Interfere with the platform’s performance or security
- Upload or distribute harmful or inappropriate content
5. Data and Privacy
Use of the platform is also governed by our Privacy Policy.
You are responsible for ensuring that any personal data (including student data) uploaded to MasteryByte is collected and used in compliance with applicable data protection laws.
6. Intellectual Property
All content, software, and materials provided by MasteryByte are owned by or licensed to us and are protected by intellectual property laws.
You retain ownership of the content you upload, but grant us a limited licence to use it for the purpose of providing the service.
7. Availability of Service
We aim to provide a reliable service but do not guarantee uninterrupted access. We may suspend or modify the platform for maintenance, updates, or improvements.
8. Payments and Subscriptions
If you subscribe to a paid plan:
- Fees will be clearly communicated before purchase
- Subscriptions may renew automatically unless cancelled
- You are responsible for any applicable taxes
Failure to pay may result in suspension of access.
9. Termination
We may suspend or terminate your access if you breach these Terms.
You may stop using the service at any time. Upon termination, access to your account and data may be removed after a reasonable period.
10. Limitation of Liability
To the fullest extent permitted by law, MasteryByte shall not be liable for:
- Indirect or consequential losses
- Loss of data, revenue, or business
- Any issues arising from misuse of the platform
Our total liability shall be limited to the amount paid by you for the service in the preceding 12 months.
